2.2. For users in the European Union, these Terms shall also comply with applicable EU laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) and the EU Consumer Rights Directive.

3. Platform Role and Services

3.1. Platform Status

  • We operate solely as a technology platform that facilitates connections between service providers and users
  • We do not provide or endorse any services offered through our platform
  • We are not a party to any agreement between users and service providers
  • Not all service providers are automatically available for instant booking
  • Service providers may need to confirm bookings before they become binding

3.2. Booking Process

  • Some bookings may require explicit confirmation from the service provider
  • A booking is not guaranteed until confirmed by the service provider
  • Service providers are solely responsible for accepting or declining booking requests
  • We are not responsible for any cancellations, scheduling conflicts, or service quality issues

4. Service Provider Terms

4.1. Eligibility

  • You must be at least 18 years old
  • You must have the legal authority to provide the services you offer
  • You must comply with all applicable local, state, federal, and international laws and regulations

4.2. Service Provider Obligations

  • Maintain accurate and up-to-date information about your services
  • Honor all confirmed bookings made through our platform
  • Maintain appropriate insurance coverage
  • Comply with all applicable licensing requirements
  • Maintain appropriate standards of professional conduct

4.3. Commission and Fees

  • We charge a 5% commission on all transactions processed through our platform
  • Monthly subscription fees may apply for cash-only businesses
  • All fees are non-refundable unless otherwise required by law

5. User Terms

5.1. Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account

5.2. Prohibited Activities

  • Attempting to circumvent our fee structure
  • Harassing or engaging in abusive behavior
  • Providing false or misleading information
  • Attempting to access, tamper with, or use non-public areas of the Services
  • Using the Services for any illegal or unauthorized purpose

6. Intellectual Property

6.1. Our intellectual property rights include but are not limited to:

  • All software, text, media, and other content
  • Our logo, trademarks, and brand elements
  • The design, selection, and arrangement of our Services

6.2. You retain all rights to your content but grant us a worldwide, non-exclusive license to use, store, and display your content for the purpose of providing and improving our Services.

7. Limitation of Liability

  • We act solely as an intermediary platform
  • We do not guarantee the quality, safety, or legality of services offered
  • We do not verify the credentials or qualifications of service providers
  • We are not responsible for any agreements made between users and service providers
  • Booking confirmation times may vary by service provider

7.2. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any damages exceeding the amount paid by you to us in the preceding 12 months

8. Indemnification

You agree to indemnify and hold harmless Fuse Link Inc., its officers, directors, employees, and agents from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with:

  • Your access to or use of the Services
  • Your violation of these Terms
  • Your violation of any third-party right
  • Your violation of any applicable law, rule, or regulation

9. Dispute Resolution

9.1. For US Users:

  • Any dispute shall be resolved through binding arbitration in Delaware
  • Class action waiver applies
  • Small claims court matters are excluded from arbitration requirement

9.2. For EU Users:

  • EU users retain their right to bring legal proceedings in their local courts
  • Alternative dispute resolution mechanisms are available as required by EU law

11. Severability

12. Entire Agreement

These Terms constitute the entire agreement between you and Fuse Link Inc. regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and Fuse Link Inc.
